Given the current expectations, the judiciary faces more responsibilitiesDue to the novelty of some concepts and examples of individual rights and freedoms, as well as neglecting the responsibility of other powers in the realization of these rights, lack of comprehensive and transparent law, weak enforcement guarantees, ambiguity in the realm of freedom and incompatibility of some concepts in the Islamic legal system. With the Western legal system, ambiguity within the duties of the relevant agencies and institutions in the restoration of individual rights and freedoms, lack of coordination and participation of other forces and lack of explanation and distribution of responsibilities in this area, has created several obstacles.}, keywords = {challenge,Constitution,Individual freedoms,judiciary,Justice,legitimate freedoms}, title_fa = {قوه قضائیه و چالش های مربوط به حقوق و آزادی های فردی}, abstract_fa = {محل تجلی عدالت و آخرین ملجاء و پناهگاه مردم هر جامعه، تشکیلات قضائی آن کشور است. در مجادلات و مخاصمات، تصمیم محکمه، فصل الخطاب بوده و تحقق عدالت و تضمین امنیت و گسترش عدل و آزادی های مشروع، منوط به عملکرد قوه قضائیه است. با  توجه به تمایلات شهروندان، جهت تحقق و تضمین حقوق و آزادی های فردی ، میزان انتظارات در برخورداری از این حقوق، رو به تزاید است. شهروندان دست یابی به حقوق شهروندی، جلوگیری از سوء رفتار، شکنجه، بازداشت، توقیف و ضبط اموال و تصرف بیجا در اموال، مشارکت در تصمیم گیری ها و تصمیم سازی ها، برقراری عدالت، رعایت کرامت انسانی و مصادیقی از این دست را، حقوق بدیهی خود می دانند و در مقابل، زمامداران نیز با تکلیف تامین این حقوق مواجه هستند. با توجه به انتظارات موجود، قوه قضاییه با تکالیف مضاعف تری مواجه است که به لحاظ جدید بودن برخی از مفاهیم و مصادیق حقوق و آزادی های فردی و همچنین مغفول ماندن مسئولیت سایر قوا در محقق شدن این حقوق، فقد قانون جامع و شفاف، ضعف ضمانت اجرا، ابهام در حدود و قلمرو آزادی و ناسازگاری برخی از مصادیق آن در نظام حقوقی اسلام با نظام حقوقی غرب، ابهام در حدود وظائف دستگاهها و نهادهای ذیربط در احیاء حقوق و آزادی های فردی، عدم هماهنگی و مشارکت سایر قوا و عدم تبیین و توزیع مسئولیت ها در این حوزه، موانع متعددی را بوجود آورده است.}, keywords_fa = {چالش,قوه قضاییه,آزادی های مشروع,آزادی های فردی,قانون اساسی,عدالت}, url = {https://www.thdad.ir/article_243200.html}, eprint = {https://www.thdad.ir/article_243200_33f8ca2ae4befaeef27fb17c3064baf3.pdf} }
