However, the need to make every effort to prevent such crimes and to take the necessary measures to ensure international security prompted the international community to pursue a "principled criminal policy" in this area. The international community's aggressive response to nuclear crime culminated in the ratification of the International Convention for the Suppression of Nuclear Terrorism on 13 April 2005. The Convention's comprehensive approach seeks to provide a framework for the implementation of national and regional actions by States by developing and expanding international cooperation on nuclear terrorist crimes. The convention, while adopting a global approach set out in the former counterterrorism treaties, considers a preventive strategy against any nuclear terrorist offenses and criminalizes the act committed under it. Today, the main solution to prevent a nuclear catastrophe is to adopt preventive and repressive strategies in the acquisition of any nuclear equipment or fissile material by criminal groups to build an indigenous underground nuclear weapon. At the same time, the international community, with its convergence and consensus in the implementation of UN legal policies with a focus on common values and approaches to nuclear terrorism, will succeed in preventing and suppressing all aspects of this issue.}, keywords = {Terrorist Crimes,Nuclear Terrorist Crimes,Counter-Terrorism Treaties,Convention on the Suppression of Nuclear Terrorism}, title_fa = {شناخت و تبیین تحولات تقنینی کیفری بین‌المللی در قبال جرایم تروریستی هسته‌ای}, abstract_fa = {جرایم تروریستی هسته‌ای جدیدترین و خطرناک ترین شکل جرایم تروریستی بوده و به‌رغم آنکه هنوز سایه شوم آن بر پیکره جامعه انسانی و هم‌چنین دولت‌ها سنگینی نمی‌کند، اما احتمال وقوع آن موجب نگرانی جامعه جهانی شده است. با این حال، لزوم به‌کارگیری حداکثر تلاش جهت پیشگیری از وقوع چنین جرایمی و به منظور اتخاذ تمهیدات لازم برای تأمین امنیت بین‌المللی، جامعه جهانی را بر آن نمود تا در صدد اتخاذ «سیاست جنایی اصولی و مبنا» در این زمینه برآید. اقدامات تهاجمی جامعه جهانی در قبال جرایم تروریستی هسته‌ای، با تصویب «کنوانسیون بین‌المللی راجع به سرکوب اقدام‌های تروریسم هسته‌ای» در سیزدهم آوریل 2005 به اوج خود رسید. رویکرد جامع این کنوانسیون درصدد است با توسعه و گسترش همکاری‌های بین‌المللی در قبال جرایم تروریستی هسته‌ای، چارچوبی برای اجرای اقدامات ملی و منطقه‌ای دولت‌ها باشد.این کنوانسیون ضمن اتخاذ رویکردی جهانی مقرر در معاهدات ضدتروریسم سابق، راهبرد پیش‌گیرانه در قبال هرگونه جرایم تروریستی هسته‌ای مدنظر قرار داده و براساس آن اقدام ارتکابی را، جرم‌انگاری نمود. امروزه راه حل اصلی پیشگیری از یک فاجعه هسته‌ای، اتخاذ و اعمال راهبردهای پیشگیرانه و سرکوب‌گرانه در تحصیل هرگونه وسایل هسته‌ای یا مواد شکافت‌پذیر توسط بازیگران غیردولتی برای ساخت یک سلاح هسته‌ای بومی زیرزمینی است. این در حالی است که جامعه بین‌المللی با هم‌گرایی و اجماع در اجرای سیاست‌گذاری‌های حقوقی سازمان ملل متحد با محوریت ارزش‌ها و رهیافت‌های مشترک در قبال جرایم تروریستی هسته‌ای، توفیق پیشگیری و سرکوب همه‌جانبه را در این محور خواهند یافت.}, keywords_fa = {جرایم تروریستی,جرایم تروریستی هسته‌ای,معاهدات ضدتروریسم,کنوانسیون سرکوب اقدام‌های تروریسم هسته‌ای}, url = {https://www.thdad.ir/article_244026.html}, eprint = {https://www.thdad.ir/article_244026_df51553f413b3eeb22869bd4f0a70c3a.pdf} }
