چکیده

میادین مشترک نفت و گاز ساختارهای هیدروکربوری هستند که از مرزهای جغرافیایی یک کشور عبور کرده و وارد قلمرو کشور دیگر می‌شوند. افزون بر این، برخی از میدان‌های نفت و گاز در مناطق مورد اختلافِ حاکمیتی دو یا چند دولت قرار می‌گیرند که در ادبیات حقوقی میادین مشترک مطالعه می‌شوند. حقوق بین‌الملل به عنوان ابزار نظم در روابط بین‌المللی دارای چارچوب کلی حقوقی در خصوص تنظیم رفتار دولت‌ها پیرامون بهره‌برداری از میادین است. پرسش این نوشتار، رویکرد کلی حقوق بین‌الملل به طور عام؛ و هم‌چنین رفتار جمهوری اسلامی ایران و قطر در بهره‌برداری از میدان مشترک پارس جنوبی از منظر خاص است. نتیجه آن که، رویکرد حقوق بین‌الملل مبتنی بر همکاری است و میدان گازی پارس جنوبی به عنوان بزرگ‌ترین میدان گازی مشترک جهان نیز از قاعده‌ی کلی همکاری مستثنا نمی‌باشد.

The trans-boundary oil and gas fields are the hydro carbon   structures that cross  territorial boundaries of one or more states . Furthermore some of oil and gas fields are located in the disputed areas and claimed by two or more states. These fields also studied in the international legal literature under  category of trans-boundary reserves.
International law as an instrument for regulating the international relations peresents general legal framework to exploitation of the trans-boundary oil and gas fields. In this article the author rises and answers some questions about the general approach of international law governing trans-boundary oil and gas fields and specially analyses legal conduct of the Islamic Republic of Iran and Qatar in South Pars gas field. The presumption of this article is that general rule in exploitation of shared or trans-boundary  oil and gas fields is “cooperation” and Iran and Qatar also should be work together with cooperative approach.
