چکیده

در نظام حقوق بین الملل تحولات قابل تاملی روی داده که ملاحظات انسانی فصل مشترک بسیاری از آنهاست. در این میان، دیوان کیفری بین المللی ساختار نوینی برای تعقیب مرتکبین جنایات بین المللی و ناقضان حقوق انسانهاست. دیوان مزبور از طریق ایجاد پیوند بین صلح و امنیت بین المللی و عدالت میبری با مقوله حقوق بشر دوستانه ارتباط یافته است که در پرتو اساسنامه اش، می تواند نقش مهمی در پیشبرد سیاست های حقوق بشردوستانه داشته باشد. تفسیر قواعد اساسنامه بر اساس حقوق بشردوستانه، ماهیت حقوق بشردوستانه جنایات بین المللی مشمول صلاحیت دیوان و...همگی دال بر تحول و تکامل حقوق کیفری بین المللی به سمت حمایت سازمان یافته از حقوق بشردوستانه و برخورد کیفری با نقض های بنیادین حقوق بشردوستانه می باشد.

In the international legal system, there have been tangible developments humanitarian consideration ate in common, meanwhile, the international criminal court is a new legal structure for prosecuting perpetrators of international crimes violators of human rights. The tribunal has been linked by linking international peace and security and justice to human rights and humanitarian law, which in the light of its constitution, can play an important role in advancing humanitarian law. The nature of the humanitarian law of international crimes within the jurisdiction of the tribunal... all reflect the evolution of international human law into organized protection of humanitarian law.However, in the current context of the international community,
