چکیده

سلب حیات اعم از عمدی و غیرعمدی در نظام حقوقی ایران جرم انگاری شده و موضوع آن، انسان زنده دیگر است که واجد وصف مهدورالدم نباشد. چالش های پیش روی اجرای ماده 302 قانون مجازات اسلامی که در مقام بیان مصادیق مهدوراادم می باشد و نیز لزوم حفظ امنیت قضایی افراد؛ ضرورت بررسی مبانی و ضوابط مربوط به این امر را دوچندان می کند. این مقاله با روش کتابخانه ای و از طریق بررسی مبانی فقهی نظام حقوقی کشور، مفهوم و مصادیق مهدورالدم را مطالعه نموده و به این نتیجه رسید که وضعیت حقوقی موجود علاوه بر آن که امنیت را به مخاطره می اندازد با لزوم رسیدگی به اعمال مجرمانه از سوی دادگستری عمومی یعنی اصل قانونی بودن دادرسی نیز در تعارض بوده و امنیت قضایی را به خطر می اندازد. لذا ضروری است با حذف ماده 302 مزبور، نسبت به پیگیری رفتار مشمولین اعمال مجرمانه مندرج در آن ماده از طریق قوه قضاییه و با توسل به دادرسی منصفانه اقدام گردد.
