The United Nations Commission on International Trade Law (UNCITRAL) at its 2002 session passed the model law on commercial conciliation, and subsequently, the General Assembly of the United Nations, by issuing resolution 18/57, approved it and advised to all states to adopt it. According to significant benefits of conciliation, including cost and time savings, the confidentiality and wide discretion of parties to the dispute over its creation, implementation ,and adoption of outcome, this can be a good alternative to legal proceedings, including judicial or arbitral tribunal to resolve trade disputes. In addition, UNCITRAL adds benefits in the model law on commercial conciliation, including the inability to accept the evidence presented in the conciliation process in arbitration or judicial proceeding, the suspension of passage of time in the conciliation process, or the possibility of referral to arbitration or judicial proceeding when conciliated, encourages the parties to use conciliation to settle disputes.
