چکیده
یکی از مؤلفه‌های محوری در برنامه‌های مبارزه با فساد، مشارکت مردمی است و از مهم‌ترین مصادیق این نوع مشارکت، گزارش‌دهی تخلف است که منجر به کشف اولیه‌ی تخلف می‌شود. «قاعده‌ی ایجاد انگیزه» از مؤلفه‌های مهم در ترغیب مردم به گزارش‌دهی فساد است. این مقاله در پاسخ به این پرسش که با کدام سازِکارهای حقوقی می‌توان انگیزه‌ی لازم برای گزارش‌دهی تخلف را ایجاد کرد، با رویکرد تطبیقی به معرفی این سازِکارها می‌پردازد. نتیجه آن‌که، اتخاذ اقدامات سلبی در راستای حذف موانع گزارش‌دهی مانند حفظ محرمانگی هویت گزارش‌دهنده و پیش‌گیری از اقدامات تلافی‌جویانه علیه وی از اهمیت زیادی برخوردار است؛ ضمن این‌که اقدامات ایجابی با تأکید بر سازِکارهای حمایتی و تشویقی مورد نیاز است.

چکیده [English]
Public participation is one of the basic factor in anti-corruption programs and one of the most important examples of this kind of participation is the whistleblowing of the corruption, which leads to the initial detection of the corruption. ‘rule of motivation creating’ is an important component in encouraging people to whistleblowing of corruption. This paper responding to the question that, which legal mechanisms can provide the necessary incentive for reporting of violations and introduces these mechanisms with a comparative approach. The result is that, adoption of negative measures to remove the reporting barriers of whistleblowing such as maintaining the confidentiality of the whistleblower and preventing retaliation against him is so important, Meanwhile, positive actions by emphasizing supportive and encouraging mechanisms is nessecary.
