چکیده

چکیده:
مهریه به عنوان یک قرارداد در کنار ازدواج با هدف هدیه‌ای از طرف زوج به زوجه و برای تحکیم روابط عاطفی آن دو در حقوق اسلام مقرر شده است. در دهه‌های اخیر منبعث از نفوذ تفکرات مادیگرایی، به تدریج به ارقام بالا و بصورت سکه طلا رایج شده است این امر در شرایط نوسان نامتعارف قیمت سکه در فاصله‌ای کوتاه، تحمیل تعهدی چندین برابری را برای وی به ارمغان می‌‌آورد که بدون تردید مغایر با قصد قراردادی است و با قاعده تبعیت عقد از قصد مخالف است، از سوی دیگر به نوعی یک‌ رویداد فرهنگی را رقم زده است، حاصل این پدیده تبعات ناخوشایند فرهنگی و نگاه اقتصادی به ازدواج و به حاشیه رفتن فلسفه ازدواج مبتنی بر نگاه معنوی-عاطفی و فرع شدن شاخص‌های معنوی بوده است. همچنین در شرایط فعلی اقتصادی کشور، با توجه به آمارهای قضایی موجود و میزان مطالبات، از عوامل تأثیرگذار گرانی طلا، افزایش تقاضای ناشی از اجرای مهریه‌های سکه است، بعلاوه توقیف بضاعت و سرمایه اقتصادی زوج از سوی زوجه و تعطیلی بخشی از فعالیت اقتصادی برای اجرای مهریه منافی نظم عمومی جامعه است؛ این رخداد اتخاذ راهکارهای قانونی تحدید تعهد زوج حدکثر تا نوسان متعارف، ممنوعیت تعیین سکه به عنوان مهر به عنوان مبانی ضرورت قانونگذاری متناسب در این راستای را روشن می‌سازد.

Abstract
Dowry is a contract. This contract is set out in Islam as a contract to be considered a gift from a couple to a wife. A large number of gold coins as dowry has become commonplace in Iran in recent years. This, in the event of a sudden fluctuation in the price of the coin in the short run, imposes a multiple equity obligation that is undoubtedly inconsistent with the contractual intention and contrary to the contractual intent. On the other hand, it has somehow triggered a cultural event, resulting from this phenomenon of unpleasant cultural consequences and the economic outlook on marriage and the marginalization of marriage philosophy based on the spiritual-emotional view and the subordination of spiritual attributes. Also, this phenomenon in Iran's current economic situation is one of the factors that increases the price of coins and gold in the Iranian market. In this unfavorable economic situation, the wife seizes the husband's property and economic capital to receive from that her dowry. It causes it to be shut down as part of the economic activity of society and this disrupts the public order of society. Solutions such as paired Commitment to the usual price fluctuation, the prohibition on coins being stamped highlights the need for appropriate legislation in this regard as the basis.
