چکیده

مدرج کردن از منظر لغوی و اصطلاحی همان‌گونه که مشخص است به معنای سنجیدن، معین کردن، اندازه گرفتن، شماره‌بندی، درجه‌بندی و .... می‌باشد. مدرج کردن بر اساس منطق جدیدی که به منطق فازی معروف شده، امروزه از جمله مباحث بسیار کاربردی و جدیدی است که در اغلب علوم از جمله علم حقوق مورد بحث و مطالعه می‌باشد. در علم حقوق نیز، از جمله گرایش‌هایی که منطبق با این مبحث جدید در قوانین و مقررات جاری نیز راه یابد، حقوق کیفری می‌باشد. پژوهش حاضر با روش توصیفی - تحلیلی و با هدف بررسی پیشینه، مبانی و اصول حاکم بر درجه‌بندی مجازات‌های در نظام حقوقی ایران به نگارش درآمده به این نتیجه می‌رسد: 1- تحولات تقنینی در نظام کیفری ایران نشان می‌دهد، مجازات‌ها در قوانین کیفری از طبقه‌بندی واحدی تبعیت نکرده است؛ بنابراین در پنج دوره قانون‌گذاری (قانون مجازات عمومی 1304، قانون مجازات عمومی سال 1352، قانون راجع به مجازات اسلامی مصوب 1361، قانون مجازات اسلامی 1370 و قانون مجازات اسلامی سال 1392) طبقه‌بندی یکسانی دیده نمی‌شود. 2- درجه‌بندی مجازات‌ها در نظام حقوقی ایران مبتنی بر مبانی فقهی و حقوقی است. بدین توضیح که برای درجه‌بندی مجازات‌ها، در فقه و حقوق، مبانی خاصی مورد توجه قرار گرفته که بعد از انقلاب اسلامی با تاکید ویزه بر مبنای شرعی اقدام به درجه‌بندی مجازات ها شده است. 3- امروزه هر چند درجه‌بندی یا فازبندی در حقوق کیفری به عنوان یکی از مباحث روز متاثر از منطق فازی است اما بی‌ارتباط با برخی از اصول شناخته شده در نظام کیفری نیست. از جمله این اصول می‌توان به اصل قانونی بودن جرم و مجازات، اصل تساوی مجازات‌ها، اصل تناسب بین جرم و مجازات، اصل فردی کردن مجازات‌ها اشاره نمود که در بیشتر نظام‌های حقوقی دنیا به‌ویژه در نظام-های حقوقی نوشته یا رومی - ‌ژرمنی از اصول پذیرفته شده محسوب می‌گردند.

چکیده [English]

Grading from a lexical and idiomatic point of view, as it is known, means measuring, determining, measuring, numbering, rating, etc. Grading based on a new logic known as fuzzy logic is one of the very practical and new topics that is discussed and studied in most sciences, including the science of law. In the science of law, criminal law is one of the trends that will be introduced in the current laws and regulations in accordance with this new topic. The present study was written with a descriptive-analytical method and with the aim of examining the background, foundations and principles governing the grading of punishments in Iran's legal system, and it comes to the following conclusion: 1- Legislative changes in Iran's criminal system show that the punishments in criminal laws are A single classification has not been followed; Therefore, the same classification is not seen in the five legislative periods (1304 General Penal Law, 1352 General Penal Law, 1361 Islamic Penal Law, 1370 Islamic Penal Law and 1392 Islamic Penal Law). 2- Grading of punishments in Iran's legal system is based on jurisprudence and legal principles. This is to explain that for the classification of punishments, in jurisprudence and law, certain principles have been taken into consideration, and after the Islamic revolution, the classification of punishments has been started with the emphasis on visa based on Sharia. 3- Today, although grading or phasing in criminal law as one of the topics of the day is influenced by fuzzy logic, it is not unrelated to some known principles in the criminal system. Among these principles, we can mention the principle of legality of crime and punishment, the principle of equality of punishments, the principle of proportionality between crime and punishment, the principle of individualization of punishments, which are written in ...
