چکیده
اجرای امر آمر قانونی توسط مأمور، از جمله عوامل موجهه‌ی جرم است؛ لیکن در خصوص مسؤولیت مأمور به اطاعت از فرامین غیر قانونی، دیدگاه‌های متفاوتی مطرح شده است. در این نوشتار، تأثیر این دیدگاه‌ها بر رویکردهای قانون‌گذاری در این عرصه بررسی می‌شود. مقنن با تمسک به این دیدگاه‌ها، جهت معرفی عملکرد اصولی مأموران در مصاف با اوامر غیر قانونی رویکردهای متفاوتی داشته است و با بررسی قوانین مرتبط این نتیجه حاصل می‌شود که اشخاص آمر با صدور دستور غیر قانونی به طور مطلق و صرف نظر از ماهیت مسؤولیت ایشان، پاسخگو هستند.
