چکیده

مسألۀ بی‌حجابی و بدحجابی به جهت تأثیر جدی که در حیات مادی و معنوی جوامع بشری دارد در دنیای ما از اهمیت خاصی برخوردار است. پس از پیروزی انقلاب اسلامی در ایران نگاه قانونی به این مسأله ایجاد شده است. این پژوهش در پی بررسی سیاست‌جنایی مشارکتی و پیشگیرانۀ جمهوری اسلامی ایران و به دنبال پاسخ به میزان و امکان مداخله نهادهای غیردولتی در دو سطح فعال و انفعالی نسبت به پدیده بی‌حجابی و بدحجابی زنان است. در این راستا با تحلیل محتوا و مطالعات کتابخانه‌ای، در تلاش برای بیان اقدامات پیشگیرانه و مشارکتی در این عرصه است. یافته‌های پژوهش نشان می‌دهد برای کنترل مسألۀ بی‌حجابی و بدحجابی در جامعه باید سیاست جنایی مشارکتی و پیشگیرانه در بالاترین درجۀ اهمیت قرار بگیرد؛ به‌ویژه این‌که پدیده بی‌حجابی و بدحجابی از جهتی ممکن است ورود در حوزه مسائل مربوط به حریم خصوصی افراد تلقی شود. در این میان می‌توان به برنامه‌های خانواده‌مدار، تدابیر آموزشی، بالا بردن سطح آگاهی مردم، مشارکت مردمی، ارتقای پاسخگویی و فرهنگ‌سازی اشاره کرد که نهادینه شدن حجاب در جامعه و دست‌یابی به عدالت در این شیوه بهتر محقق می‌گردد. البته این اقدامات باید ازلحاظ کمی بیشتر و ازلحاظ کیفی مطلوب‌تر گردد.

Due to their serious effect on the material and spiritual life of human societies, inappropriate and removed hijab are particularly important in our world. There has been a legal perspective on this issue in Iran after the victory of the Islamic Revolution. This study is an attempt to investigate the participatory and preventive criminal policy of the Islamic Republic of Iran and seek to find out the extent and possibility of non-governmental organizations' intervention at both active and passive levels with regard to women's inappropriate and removed hijab. This analytical desk-study attempts to explain preventive and participatory measures in this area. The findings show that participatory and preventive criminal policy should be highly considered to control inappropriate and removed hijab in society, particularly that inappropriate and removed hijab may, in some ways, be considered as a violation of individuals' privacy. The institutionalization of hijab in society and the realization of justice are better achieved through family-oriented plans, educational measures, increased public awareness, public participation, promoted accountability, and promoted culture. These measures should indeed be increased quantitatively and made more desirable qualitatively.
