چکیده

شاید یکی از اولین تعابیری که در ارتباط با جرایم در فضای مجازی در ذهن ما تداعی می شود، جرایمی باشد که اصطلاحاً تحت عنوان منافی عفت از آن ها یاد می شود. با گسترش کاربران فضای مجازی و استفادۀ روزافزون از رایانه در تمام ابعاد زندگی بشر، انواع و نحوۀ وقوع این جرایم روز به روز بیشتر شده است. پژوهش حاضر با هدف بررسی میزان تأثیرگذاری فضای مجازی در گرایش افراد به ارتکاب اعمال منافی عفت و مقایسۀ آن نسبت به فضای حقیقی صورت گرفته است. این پژوهش به صورت توصیفی ـ تحلیلی انجام شده است. روش گردآوری اطلاعات، میدانی و ابزار گردآوری آن پرسشنامه است. جامعۀ آماری آن محدود به ۱۵۰ نفر از کاربران شبکه های اجتماعی در شهر تهران و نمونه گیری به صورت تصادفی صورت گرفته است. یافته های پژوهش بیانگر این است که میزان تأثیرگذاری فضای مجازی نسبت به فضای حقیقی در گرایش افراد به ارتکاب اعمال منافی عفت، بیشتر است. از این رو سیاست جنایی ایران در مقابله با جرایم منافی عفت در فضای مجازی کارآمد نبوده است و برای مقابله با این جرایم به برخوردهای قضایی بسنده شده، لذا تاکنون موفقیتی در کنترل آسیب های اینترنتی حاصل نشده است.

چکیده [English]

Perhaps one of the first interpretations that comes in to our mind in the context of crimes in the cyber space, the crimes are that is termed as the against of chastity. With the expansion of cyber space users and the increasing use of cyber space in all aspects of human life, the types and manner of occurrence of these crimes have been increasing day by day. The present research was done to the purpose of investigate the impact of cyber space on people’s tendency to commit acts of against chastity and compare it with real space. This research is descriptive analytic. The method of information collecting is field and its collecting tool is the questionnaire. It’s statistical society is limited to 150 people social networks users in Tehran and sampling was done randomly. The findings of the research indicate that cyber space is more effective than real space in the people’s tendency to commit acts of against chastity. Therefore, Iran’s criminal policy has not been efficient in confronting with the crimes of against chastity in cyber space and to confront with these crimes has been restricted to judicial conflicts. no success has been achieved in controlling internet damages yet.
