چکیده
پیشتر پژوهشهای حقوقی در کشور ما به شرح و تفسیر قوانین محدود بود اما، امروزه بسیاری محققان دریافتهاند که قانونگذاری نیز تابع اصول و قواعد حقوقی است؛ از این رو، در نوشتههای جدید از اصول و فنون قانونگذاری یاد شده و بر مبنای آن از نظام قانونگذاری مطلوب دفاع میشود. همچنین، نبود نظام کارآمد در حوزۀ تنقیح قوانین یکی از آسیبهای قانونگذاری در کشور ما معرفی شده است. تصویب قوانین متناقض ناشی از همین نارسایی است.
چنانچه قانونگذار در موضوع واحد دو حکم متفاوت صادر نماید، به گونهای که هر یک از آنها دیگری را نفی کند، تعارض بین دو قانون محقق است. چنین وضعیتی موجب دشواری در اجرای قانون است. زیرا، دادگاهها و نهادهای رسمی مکلفند تمامی قوانین کشور را اجرا کنند. لیکن، اجرای احکام متعدد بر موضوع واحد، ممتنع است. پس باید برای رفع معضل تناقض قوانین به طور اساسی چاره اندیشی شود تا نظام حقوقی از این دشواری رهایی یابد.
این مقاله در صدد است پارهای علل و عوامل را که موجب وضع قوانین متعارض شده شناسایی کند. آگاهی قانونگذاران علل و عوامل مزبور، نه تنها از احتمال تکرار خطا در آینده میکاهد، ضرورت بازنگری و اصلاح مقررات متعارض کنونی را بیش از پیش آشکار میکند.

Previously, legal research in our country was limited to the interpretation of lows, but today, many researchers have found that legislation is also subject to legal principles and rules. Therefore, in the new writings, the principles and techniques of legislation are mentioned and based on it, the desired legislative system is defended.
If the legislature issues two different rulings on a single issue, so that each denies the other, the conflict between the two laws is realized. Such a situation makes it difficult to enforce the law. Because official courts and institutions are obliged to implement all the laws of the country. However, it is impossible and unreasonable to enforce multiple rulings on a single subject. In addition, the inadequacy of the rules of conflict resolution has been proven in some cases and assumptions. Therefore, a solution must be found to solve the problem of contradiction of laws,
This article seeks to identify some of the causes and factors that have led to conflicting laws. Legislators awareness of these causes and factors not only reduces the likelihood of repeating the fault and enacts conflicting laws in the future, but also highlights the need to review and amend current conflicting regulations.
