چکیده

حق بر شهروندی به معنی حق برخورداری از یک سلسله حقوق مدنی، سیاسی و اقتصادی است. در اسناد متعدد حقوق بشری به لزوم چنین حقی اشاره شده، اما در هیچ سند جامع و الزام‌آوری حق بر شهروندی برای تمام افراد بشر بعنوان یک حق کلی و عام به رسمیت شناخته نشده است. این امر باعث شده است تا شمار زیادی افراد بی‌وطن و بدون تابعیت، در جهان به چشم بخورد. حق آزادانه‌ی افراد به برخورداری از شهروندی در مقابل اراده‌ی حاکمه‌ی دولت در اعطای تابعیت قرار می‌گیرد. ازینرو دولت‌ها از شناسایی این حق بعنوان یک حق بشری اجتناب می‌ورزند. جهانی شدن و ظهور و گسترش اسناد و هنجارهای حقوق بشری در نیمه‌ی دوم قرن بیستم، از حاکمیت دولت‌ها کاست و بر اهمیت انسان در نظام بین-المللی افزود و مفهوم حق بر شهروندی نیز متأثر از چنین تحولی بوده است. در نتیجه، رویکردهای پساملی‌گرایانه‌ی کنونی که منتهی به ظهور مفاهیمی چون جهان‌شهروندی و شخصیت جهانی شده، هم حاکمیت ملی را در اعطای شهروندی محدود نموده و هم مفهوم حق بر شهروندی را به گونه‌ای متحول کرده که می‌توان از آن به عنوان یک حق بشری نام برد؛ حقی که همراه با پدیده‌ی «جهانی شدن» تحکیم و توسعه نیز یافته است.

چکیده [English]

The Right to citizenship means individual’s right to have civil, political and economic rights. This right has been noticed by many human rights instruments, but no instruments contain the right to citizenship in general for all human being. This is why there are many homeless and stateless people in the world. The individual free right to citizenship emerges as an opponent for the sovereign authority of a states to granting nationality. So, states have always ignored to recognize the right to citizenship as a human right. globalization and international human rights instruments Explosion in the second half of the 20th century lead to more restriction of state sovereignty and enhanced individual’s significance in international system. The concept of the right to citizenship has been also affected by such evolutions. Thus, current post-nationalism approaches that caused the emergence of some concepts such as global citizenship and universal personhood, also lead to restriction of national sovereignty in the context of citizenship and developing the concept of citizenship. So, as a result the right to citizenship can be introduced as a human right; a right that has been consolidated and developed in the aftermath of globalization.
