چکیده

مُرده بارگی یا نکروفیلیا یک اختلال و رفتارِ غیرمتعارف جنسی است که در آن ارضای میل جنسی در تماس با مردگان حاصل می شود. این چنین رفتاری از منظر روانشناسان نوعی اختلال جنسی شدید روانی به شمار می آید و چنین بیمارانی نه تنها لزوماً سزاوار روان درمانی و بازپروری هستند بلکه مسئولیت کیفری آنان نیز در محل تردید است، منطوق مادۀ 149 ق.م.ا نیز بر چنین استنباطی دلالت دارد. درحالیکه برخلاف انتظار، قانونگذار جماع با میّت را زنا محسوب نموده (مادۀ 222ق.م.ا) و لاجرم مجازات های زنا، از شلاق حدی در جایی که مرتکب محصن نباشد تا رجم برای مرتکبِ محصن و اعدام در مواردی چون زنای با محارم بر زانی مترتب می گردد. صرفنظر از اهلیّت فرد مبتلا به نکروفیلیا برای برخورداری مسئولیت کیفری، جرم انگاری یا قرار دادن چنین رفتاری در سیطرۀ حقوق جزا از اصول و معیارهای حاکم بر این امر نیز پیروی نمی کند و به همین ترتیب اشکالات جرم انگاری این رفتار در مواجهه با مستندات فقهی آن هم رخ نشان می دهد. در این نوشتار برآنیم که به تحلیل این نارسایی ها بپردازیم.

چکیده [English]

Adultery with the dead or necrophilia is an abnormal sexual disorder in which sexual pleasure arises from liaison with the corpses. According to psychologists, this type of sexual intercourse is a severe mental disorder, and such patients not only need psychotherapy, but also their criminal responsibility is questionable. Article 149 of the Islamic Penal Code also implies such an inference, but contrary to expectations, the legislature has considered sexual intercourse with a corpse to be adultery and the related punishments are considered for the perpetrator. (Whipping for an unmarried adulterer and execution for married adultery) Regardless of the eligibility of a person with necrophilia to be held criminally liable, criminalizing or placing such behavior under the control of criminal law does not follow the principles and criteria governing this matter. Thus, the criminological challenges of this behavior appear in the face of its jurisprudential documents. In this article, we intend to analyze these shortcomings
